Terms of Use

These terms are an agreement between you and the developer of Defiant (“Defiant”, “we”, “us”). They cover the Defiant app for iPhone and Apple Watch and this website. By downloading or using Defiant you agree to them. If you don't agree, please don't use the app.

1. Not medical advice

Defiant is a training log that suggests weights, reps, rest, stretches and programs from the information you give it. It is not a medical device and doesn't diagnose, treat or prevent any condition. Nothing in the app, on this website or from our support is medical, physiotherapy or nutrition advice, and none of it replaces a doctor, physiotherapist or qualified coach who can see you in person.

3. Targets are suggestions

Weight and rep targets, one-rep-max estimates, warm-up sets, deloads, rest times, and calorie, distance and pace figures are calculated estimates. They can be wrong, for example because of mistyped or imported data, different equipment, or a day when you haven't recovered. They can't see your form, your equipment or how you feel today.

You decide what you lift. Never attempt a weight or number of reps you aren't confident you can do safely, and lower or skip any target that doesn't feel right.

Strength training, running, stretching and other exercise carry inherent risks, including strains, sprains and other injuries and, rarely, serious injury, heart problems or death. By using Defiant you confirm you understand these risks and voluntarily accept them. You're responsible for your training decisions, where you train and the equipment you use.

6. Who can use Defiant

You must be at least 13 years old. If you're under 18, or under the age of majority where you live, you may use Defiant only with the permission of a parent or guardian, who agrees to these terms on your behalf.

7. Your data

Your workouts and other data belong to you. They're stored on your devices and, if you turn on iCloud sync, in your own private iCloud, as described in our Privacy Policy. We can't see or recover them. Keep your own backups (Settings → Your data → Export workouts). We aren't responsible for lost or damaged data, including from device problems, iCloud, imports or deleting data.

8. Importing from other apps

Defiant can import files exported from other apps. Alpha Progression, Hevy, Strong, Fitbod, RepCount, Shred and any other product names mentioned are trademarks of their owners. Defiant isn't affiliated with or endorsed by them. Check your imported workouts, since files from other apps may not convert perfectly.

9. Apple Health and Apple Watch

Connecting Apple Health or Apple Watch is optional. Heart rate, energy, distance and pace figures come from your devices and our estimates, may not be accurate, and shouldn't be relied on for medical purposes.

10. Defiant Pro and purchases

Some features may require Defiant Pro, a paid subscription.

Early members. The first 1,000 people to download Defiant get Defiant Pro free for as long as we offer Defiant Pro, including Pro features we add later. Whether you qualify is based on the original download date the App Store records for your Apple Account. Because App Store download counts arrive with a delay, the cutoff may include somewhat more than 1,000 people, and once the app has shown you as an early member, you stay one. The benefit belongs to that Apple Account and can't be transferred or exchanged for money.

11. Using the app

We give you a personal, non-exclusive, non-transferable, revocable licence to use Defiant on Apple devices you own or control, as permitted by Apple's Usage Rules. Please don't copy, sell or redistribute the app or its content (including exercise images, illustrations, voice recordings and programs), reverse engineer it except where the law allows, or use it for anything unlawful. The app, its design and content, and the Defiant name belong to us or our licensors. Third-party components are credited in Settings → About → Acknowledgements.

12. Changes

We may add, change or remove features, and we may stop offering Defiant. If we change these terms, the new version will appear in the app and on this page with a new effective date. If you keep using Defiant after that, you accept the new terms.

13. No warranties

To the fullest extent the law allows, Defiant is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don't promise that the app will be error-free or uninterrupted, or that using it will produce any particular result.

14. Limitation of liability

To the fullest extent the law allows, we and our contractors and licensors aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from or related to Defiant or these terms, however caused, even if we were told they might happen. Our total liability for any claim is limited to the greater of the amount you paid for Defiant in the 12 months before the claim, or US$50.

15. What these terms don't limit

Some places don't allow some of the exclusions and limits above, so they may not all apply to you. Nothing in these terms excludes or limits liability that can't be excluded or limited by law, such as liability for fraud or, where the law requires it, for death or personal injury caused by negligence. Nothing in these terms affects your legal rights as a consumer.

16. Indemnity

To the extent the law allows, you agree to cover any claims, losses and reasonable costs (including legal fees) brought by someone else that arise from your breach of these terms or misuse of Defiant.

17. Apple

These terms are between you and us, not Apple. Apple isn't responsible for Defiant or its content and has no obligation to provide maintenance or support for it. If Defiant fails to meet any applicable warranty, you can tell Apple, and Apple will refund the price you paid for it, if any; to the fullest extent the law allows, Apple has no other warranty obligation for Defiant. We, not Apple, are responsible for handling any claims relating to Defiant, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that it infringes someone else's intellectual property. You confirm that you aren't located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you aren't on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

18. Ending

You can stop using Defiant at any time by deleting it and cancelling any subscription. We may end your licence if you break these terms. Sections 1–5 and 13–19 continue to apply afterwards.

19. General

These terms are governed by the laws of the place where Defiant's developer is based, without regard to conflict-of-law rules. If you live somewhere whose consumer laws give you the right to rely on your local law or bring claims in your local courts, you keep that right. Before starting any formal dispute, please contact us so we can try to resolve it informally. If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms, we haven't waived our right to do so later.
